QRING APP TERMS OF USE (QRING BV)

  1. General

These Terms of Use (“Terms of Use”) describe the conditions under which the QRing application (hereinafter referred to as “the App” may be used). The App is owned by QRing B.V.  located in Rotterdam in the Netherlands.

  1. Applicability and changes
  • These Terms of Use apply to your use of the App. We have the right to change these Terms of Use unilaterally. You will be informed in good time about the changed terms via an update, a message from the App or an e-mail message.
  • We have the right at any time to modify the App, modify or delete data, restrict the use of the App or deny access to the App in whole or in part, temporarily or permanently. We will inform you about this in a timely and appropriate manner.
  1. Using the App
  • You are responsible for the correct and careful use of the App. You must refrain from unauthorized or careless use of the App. In particular, you should:
    • data truthfully.
    • confidentially handle personal login codes and keep them secret from other persons.
    • not to use the App for acts and/or conduct that violate applicable laws or regulations, morals, public order or third-party rights. Under no circumstances is it permitted to add data, documents or files to the App that have an illegal or offensive (including sexist, pornographic, racist or discriminatory) content or (otherwise) infringe the privacy of third parties.
    • not to use the App in such a way that its (proper) functioning is prevented, security is infringed or damage is caused to us, the App or third parties.
    • not to spread viruses through the App, or to disrupt devices or systems in other ways, from us or other users of the App.
    • respect our good name and reputation at all times and ensure that the use of the App does not in any way damage our rights and/or reputation.
    • follow all our instructions and regulations for the use of the App.
  • If you violate these Terms of Use, we have the right to take any measures we deem necessary, such as suspending or terminating access to the App or redressing any damages or costs from you.
  • You may not grant third parties access to the App, do not make the App available to third parties, sell, rent, de-compile, reverse engineer or modify without our prior consent. Nor may you remove or have circumvent technical features intended to protect the App.
  1. Intellectual property rights
  • All intellectual property rights and/or similar rights to the App, including the underlying software, texts, images, video and sound fragments, are exclusively and exclusively vested in us or with our licensors. The ownership of data added by you to the App remains your property.
  • We grant you a non-exclusive, non-sublicensable and non-transferable license to use the App within the framework of our stated objectives. It is not permitted to use the App for other purposes.
  1. Liability
  • The App has been compiled with the utmost care. However, we cannot guarantee that the App will always be or will be available without interruption, errors, viruses, malware or defects and that the information provided is complete, correct or up-to-date. We reserve the right to temporarily or permanently discontinue the App (unannounced), without you being entitled to derive any rights from it.
  • We are not liable for damage or injury resulting from the use of the App, unless the damage or injury is the result of intent or gross negligence on our part. We are never liable for indirect damage or consequential damage, such as lost turnover or income. You indemnify us against all possible claims from third parties as a result of the use of the App.
  1. Privacy Statement
  • The Privacy Statement is part of these Terms of Use applies to any privacy-sensitive information or personal data that you provide to us through the App. We attach great importance to your privacy and therefore exercise the utmost care in the treatment and protection of personal data. You can find the current version of the privacy statement on the website:  qring.eu/privacy.
  1. Viewing, correcting or removing
  • You have the right to access, correct or delete your personal data. In addition, you have the right to withdraw your possible consent to the data processing or to object to the processing of your personal data. You have the right to data portability. This means that you can submit a request to us to send the personal data that we have about you in a computer file to you or another organisation mentioned by you.
  • You can send a request for access, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to privacy@qring.eu
  • To ensure that the request for inspection has been made by you, we ask you to send a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.
  • We would also like to point out that you have the possibility to file a complaint with the national supervisory authority, the Dutch Data Protection Authority.
  1. Cookies
  • A cookie is a small text file that is stored on your computer, tablet or smartphone when you first use the App. You can opt out of these cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via the settings of your browser.
  • Our App uses the following cookies:
    • Functional cookies: these are cookies that are necessary for the technical operation of the App and your ease of use. For example, they make the App work properly and remember your preferred settings. It also allows us to optimize our App. These are analytical cookies that do not infringe on your privacy for which we do not need your prior consent.
    • Tracking cookies: we place cookies that track your surfing behaviour so that we can offer tailor-made content and advertisements. When we first used our App, we already informed you about these cookies and asked for permission to place them. You can opt out of cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via the settings of your browser.
    • Google Analytics: cookies are placed on this App from the American company Google, as part of the “Analytics” service. QRing B.V. uses this service to get reports on how the App is used and to measure its quality and effectiveness. We use Google Analytics in the manner prescribed by the Dutch Data Protection Authority in order to be subject to the exception in the cookie law, so that we do not need your prior consent for the use of Google Analytics.
  1. Disputes

Dutch law applies to these Terms of Use. Disputes relating to the App or these Terms of Use will be settled by the competent court in the place where we are established, unless mandatory law requires another competent court.
